Anyone with the drive and dedication can be successful with ACN, and the first step is deciding to give something new a try. The best-of-the-best in ACN, those who have dedicated the time and effort it takes to reach the pinnacle of success in our company, are referred to as the Circle of Champions. This group consists of the top producers and money earners at ACN. They are selected on an annual basis, at the beginning of each year.
For those of you who have been to our website recently, you will have noticed that we have updated the site so it is responsive, mobile friendly and — more importantly — in line with our brand strategy. We want people to come into our offices in Melbourne and Sydney and not be surprised…but expect a dynamic and creative workspace, with great people, open plan, dual screens and a bit of buzz.
We think the new site captures this well.
We are currently transitioning all other parts of our business — business cards, letterhead, collateral and this newsletter — across to the new style. Any comments are welcome! The new site stresses different and better. It is fairly easy to call yourself different — but to be different and better at the same time takes a little more.
We believe it is more than possible and already have done several exercises of comparing performance across portfolios of claims — average costs, average legal spend as examples of measures we have used. We remain committed to measurement of claims performance so we are accountable and can demonstrate to our clients that we are indeed different, but better.

Jackson graced the big screen presenting what I could only describe as a ludicrous tale about Snakes on a Plane. This movie does not seem nearly as bizarre since we received a claim for compensation involving, you guessed it, snakes in the workplace.
The claimant walked down a set of stairs into the room without turning on the light. Whilst concentrating on remaining stealth like so as to avoid any confrontation with the snake, he misplaced his foot on the stairs due to his limited vision, causing him to slip and fall backwards and let go of the hand rail, sustaining injuries to his back.
Now if Mr Jackson taught us anything in his blockbuster… The claimant has interestingly presented extensive evidence that snakes were commonly sighted on the grounds of his workplace, a remote exchange station, and was an ongoing safety issue. In fact, the claimant alleges to have been trained in snake safety by the occupant and that part of this training required the claimant to not turn the lights on if a snake was spotted.
This strategy was allegedly imposed so as to avoid provoking any attack. The allegations forming the basis of the claim are in dispute and the defence is effectively that the claimant contributed to his own injury by not turning on the light and failing to take proper care for his own safety.
Despite the obvious frivolity of this claim, the claimant has instructed lawyers and the matter is due to proceed to Compulsory Conference in the new year.
Did we mention that it seems there was not in fact a snake in the room as the claimant suspected? What we do know as a result of claims of this calibre is the importance of conducting thorough investigations into all incidents as soon as they are reported so claims can be effectively resisted — the stronger your investigation and your liability position, the better the prospects of successfully resisting a claim.
It seems that snakes have become somewhat of a theme in my day to day as one of my airport clients have advised they have experienced snake handlers attend to provide OHS training as they commonly find deadly snakes sunbathing on the runway.
